A RESOLUTION AUTHORIZING THE APPOINTMENT OF SPECIAL COUNSEL FOR THE PURPOSES OF ASSISTING INDIVIDUALS IN THE PRESENTATION OF PRIVATE PETITION FOR ANNEXATION OF CERTAIN REAL ESTATE ALONG THE NORTH CORRIDOR AND JOHNSON ROAD, AND DECLARING AN EMERGENCY

WHEREAS, the Council of the Village of West Lafayette, Ohio, wishes to assist the individuals living in the vicinities of the North Corridor and Johnson Road to present one or more petitions as may be desirable for the annexation of real estate held by parties living in those vicinities into the Village of West Lafayette, Ohio;

WHEREAS, the Ohio State Auditor’s Office has recently indicated that the payment of the costs of such proceedings including attorney’s fees is a permissible expense for the Village of West Lafayette, Ohio;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF WEST LAFAYETTE, STATE OF OHIO, AS FOLLOWS:

1.   William M. Owens, Esq., shall be designated special counsel for the Village of West Lafayette, Ohio, for the purpose of preparing and presenting private petitions for the annexation of real estate in the vicinity of the North Corridor and in the vicinity of Johnson Road, as has been heretofore indicated by the Annexation Committee of the Council of the Village of West Lafayette, Ohio.

2.   The Village of West Lafayette, Ohio, shall authorize and pay such reasonable attorney’s fees as may be charged by William M. Owens, along with such normal and reasonable expenses as surveying costs, mileage, filing fees, postage, and the like which may be incurred, for the above indicated annexation projects.

3.   This ordinance shall be declared to be an emergency ordinance, the emergency being the need to present such petitions in a timely manner so as to allow the prompt annexation of the areas in interest so as to provide municipal water and sewer to protect the lives, property and safety of individuals within the areas described above and of the residents of the Village living in the vicinities  thereof, and this ordinance shall therefore take effect immediately upon passage by Council.
