RESOLUTION PURSUANT TO O.R.C. § 721.15 DETERMINING THAT
CERTAIN TANKER EQUIPMENT IS NOT NEEDED FOR PUBLIC USE AND THAT CERTAIN OTHER
TANKER EQUIPMENT IS NEEDED, AND DECLARING AN EMERGENCY
WHEREAS, it has been determined that the 1972 GMC tanker presently used by
the Fire Department of the Village of West Lafayette, Ohio, is not needed
for public use;
WHEREAS, it has been estimated that the value of the 1972 GMC tanker presently
used by the Fire Department of the Village of West Lafayette, Ohio, is in
excess of One Thousand and no/100 Dollars ($1,000.00);
WHEREAS, it has been determined that a 1996 Freightliner FL70 tanker such
as has been recently examined and tested by the Fire Department of the Village
of West Lafayette, Ohio, is needed for public use;
WHEREAS, the Council of the Village of West Lafayette, Ohio, further finds
that it will be to the best interest of the municipal corporation that such
sale of said unneeded 1972 GMC tanker be made simultaneously with the purchase
of the new 1996 Freightliner FL70 tanker;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF WEST LAFAYETTE,
STATE OF OHIO, as follows:
1. The Council of the Village of West Lafayette, Ohio, shall offer for sale
said 1972 GMC tanker and shall advertise for bids pursuant to O.R.C. § 721.15
for said 1972 GMC tanker;
2. The Council of the Village of West Lafayette, Ohio, shall advertise for
bids pursuant to O. R.C. § 721.15 for the purchase of said 1996 Freightliner
FL70 tanker;
3. At the discretion of the Council of the Village of West Lafayette, Ohio,
the Council of the Village of West Lafayette, Ohio, may have the selling
price for said 1972 GMC tanker credited against the purchase price of
said 1996 Freightliner FL70 tanker and may consummate such sale and purchase
by a single contract with the lowest and best bidder to be determined by subtracting
from the selling price of said 1996 Freightliner FL70 tanker to be purchased
by said municipal corporation the purchase price offered for said municipally
owned 1972 GMC tanker;
4. The Clerk-Treasurer of the Village of West Lafayette, Ohio, shall herewith
carry out the advertising for bids pursuant to O.R.C. § 721.15 pursuant
to the above provisions of this Resolution and shall advertise for not
less than two nor more than four consecutive weeks in a newspaper of general
circulation within the Village of West Lafayette, Ohio, and he shall
include in the same advertisement a notice of willingness to accept bids for
the purchase of said 1972 GMC tanker not needed for public use, and to have
the amount of such bids subtracted from the selling price of said 1996 Freightliner
FL70 tanker as a means of determining the lowest and best bidder;

This Resolution shall be and herewith is declared to be an emergency
resolution, the emergency being the necessity of upgrading the equipment
of the Fire Department of the Village of West Lafayette, Ohio, so as to
protect the lives and property of the residents of the Village of West
Lafayette and to assist in putting out fires in the surrounding countryside
which if spread can endanger the lives and property of the residents of the
Village of West Lafayette, Ohio, and this Resolution shall therefore be
effective immediately upon passage by Council.
