ORDINANCE PURSUANT TO O.R.C. § 721.15 AUTHORIZING THE TRADE-IN
OF CERTAIN TANKER EQUIPMENT NOT NEEDED FOR PUBLIC USE AND AUTHORIZING THE
PURCHASE OF CERTAIN OTHER TANKER EQUIPMENT, AND DECLARING AN EMERGENCY
WHEREAS, it has been previously been determined that the 1972 GMC tanker
presently used by the Fire Department of the Village of West Lafayette, Ohio,
is not needed for public use pursuant to Resolution No. 26-2001 passed September
28, 2001 by the Council of the Village of West Lafayette, Ohio;
WHEREAS, the Council of the Village of West Lafayette, Ohio, pursuant to
the said Resolution has found that it will be to the best interest of the
municipal corporation that such sale of said unneeded 1972 GMC tanker be made
simultaneously with the purchase of the new 1996 Freightliner FL70 tanker;
WHEREAS, the Clerk-Treasurer of the Village of West Lafayette, Ohio, pursuant
to said Resolution has carried out the advertising for bids pursuant to O.R.C.
§ 721.15 and has included in the same advertisement a notice of willingness
to accept bids for the sale by the Village of West Lafayette, Ohio, of said
1972 GMC tanker, and to have the amount of such bids subtracted from the selling
price of said 1996 Freightliner FL70 tanker as a means of determining the
lowest and best bidder;
WHEREAS, Finley Fire Equipment pursuant to a letter dated October 3, 2001,
has submitted a bid providing for the sale of said unneeded 1972 GMC tanker
with the simultaneous purchase of the new 1996 Freightliner FL70 tanker;
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF WEST LAFAYETTE,
STATE OF OHIO, as follows:
1. The Council of the Village of West Lafayette, Ohio, herewith declares
the bid of Finley Fire Equipment pursuant to a letter dated October 3, 2001,
for the purchase of a 1996 Freightliner FL-70 tanker at a price of $69,500.00
with a trade-in allowance of $4,800.00 for the 1972 GMC tanker presently owned
by the Village of West Lafayette, Ohio, giving a total cost (including trade-in)
of $64,700.00, to be the lowest and best bid;
2. The Clerk-Treasurer, the Village Administrator, and all other officials
and officers as may be needed are herewith authorized and directed to enter
into and execute a contract on behalf of the Village of West Lafayette with
Finley Fire Equipment for the purchase of the 1996 Freightliner
FL-70 tanker and giving as a trade-in therefore the 1972 GMC tanker, as soon
as suitable financing has been obtained as required by law;
3. This Ordinance shall be and herewith is declared to be an emergency ordinance,
the emergency being the necessity of upgrading the equipment of the Fire Department
of the Village of West Lafayette, Ohio, so as to protect the lives and property
of the residents of the Village of West Lafayette and to assist in putting
out fires in the surrounding countryside which if spread can endanger the
lives and property of the residents of the Village of West Lafayette, Ohio,
and this Ordinance shall therefore be effective immediately upon passage by
Council.
