AN ORDINANCE DECLARING THE AVAILABILITY OF MUNICIPAL
SERVICES FOR THE PROPOSED JOHNSON ROAD ANNEXATION, AND
DECLARING AN EMERGENCY
WHEREAS, certain landowners holding real estate in unincorporated areas of
Lafayette Township, County of Coshocton, and State of Ohio, lying along Johnson
Road have presented a Petition for Annexation of the within described territory
to the Village of West Lafayette, Ohio;
WHEREAS, Thomas B. Lahna, the agent for said landowners has caused written
notice of the filing of the Petition with the Board of County Commissioners,
Coshocton County, Ohio to be delivered to the Clerk-Treasurer of the Village
of West Lafayette, Ohio pursuant to Ohio Revised Code Section 709.031;
WHEREAS, Ohio Revised Code Section 709.031 mandates that the Council of the
Village of West Lafayette, Ohio, adopt a statement indicating what services
of the Village of West Lafayette, Ohio, will be provided to the territory
proposed for annexation upon annexation;
WHEREAS, said statement must be submitted to the Board of Commissioners of
Coshocton County, Ohio, before the hearing on said Petition for Annexation;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF WEST LAFAYETTE,
STATE OF OHIO as follows:
1. The following services of the Village of West Lafayette, Ohio shall be
provided:
(1) municipal water service;
(2) municipal sewer service-not
presently available; the Village intends to supply sewer service as a future
project when suitable funding or grant money becomes available;
(3) municipal police protection
(4) municipal fire protection
2. The territory to which such services shall be provided is described as
follows:

Description for the Village of West Lafayette in Lafayette Township, Coshocton County, Ohio.
Being a tract of land in the First Quarter, Range 5W, Township 5N, Lafayette
Township, Coshocton County, State of Ohio, and being further described as
follows;
Note: North based on Deed O.R. 142/194.
Research Data: Deeds and plats as shown on plat and called out in this
description.
Beginning at a point at the Southeast corner of Lot 891, Sharrock's Third
Subdivision, P.B. 3, Page 38, and on the North line of an alley;
thence, with the said North line of the alley the
following two (2) courses;
1. 270 degrees 22' 52", a distance of two hundred and no hundredths
(200.00) feet to a recovered concrete monument;
2. continuing 270 degrees 22' 52", a distance
of sixteen and fifty hundredths (16.50) feet to a point on the centerline
of Johnson Road;
thence, with the said centerline of Johnson Road,
180 degrees 22' 52", a distance of sixteen and no hundredths (16.00)
feet to a point at the Northwest corner of the lands of W.D. & L.R. Moore
(369/888);
thence, with the said lands of W.D. & L.R. Moore
the following four (4) courses;
1. 90 degree 22' 52", a distance of two hundred sixteen and fifty
hundredths (216.50) feet to a point;
2. 180 degrees 22' 52", a distance of one hundred fifty and no
hundredths (150.00) feet to a point;
3. 270 degrees 22' 52", a distance of two hundred and no hundredths
(200.00) feet to a recovered 3/4" iron bar;
4. continuing 270 degree 22' 52", a distance
of sixteen and fifty hundredths (16.50) feet to a point on the said centerline
of Johnson Road;
thence, with the said centerline of Johnson Road,
180 degrees 22' 52", a distance of sixty and no hundredths (60.00) feet
to a point at the Northwest corner of the lands of M.C. & L.S. Holder

(16.50) feet to a recovered 3/4" iron bar;

3. 180 degrees 22' 52", a distance of one hundred fifty and no
hundredths (150.00) feet to a recovered 1/2" pipe;

a distance of four hundred twenty-four and forty-eight hundredths (424.48)
feet to a point at the Northwest corner of the lands of The Frontier Power
Co. (202/562, O.R. 92/883 & O.R. 94/1019);
thence, with the said lands of The Frontier Power
Co. the following six (6) courses;
1. 90 degrees 22' 52", a distance of twenty and no hundredths (20.00)
feet to a set 5/8" rebar with plastic cap;
2. continuing 90 degrees 22' 52", a distance
of eighty-five and no hundredths (85.00) feet to a set 5/8" rebar with
plastic cap;
3. 180 degrees 22' 52", a distance of one hundred forty and no
hundredths (140.00) feet to a set 5/8" rebar with plastic cap;
4. continuing 180 degrees 22' 52", a distance
of twenty-two and no hundredths (22.00) feet to a set 5/8" rebar with
plastic cap;
5. 270 degrees 22' 52", a distance of eighty-five and no hundredths
(85.00) feet to a set 5/8" rebar with plastic cap;
6. continuing 270 degrees 22' 52", a distance
of twenty and no hundredths (20.00) feet to a point on the said centerline
of Johnson Road;
thence, with a projection of the South line of the said lands of The Frontier
Power Co. and continuing 270 degrees 22' 52", a distance of sixteen and
fifty hundredths (16.50) feet to a point on the West line of said Johnson
Road;
thence, with the said West line of Johnson Road, 00 degrees 22' 52",
a distance of one thousand nine hundred eight and seventy-one hundredths (1908.71)
feet to a 5/8" rebar with plastic cap set on the South line of the lands
of M.A. Brown (O.R. 40/75);
thence, with the said lands of M.A. Brown, the lands
of K.L. Nolan (O.R. 109/351) and the lands of W.C. Gorscak Jr. (289/155) the
following two (2) courses;
1. 270 degrees 08' 53", a distance of one hundred fifty and twelve
hundredths (150.12) feet to a set 5/8" rebar with plastic cap;
2. 00 degrees 18' 46", a distance of three hundred twenty nine
and eighty-four hundredths (329.84) feet to a point on the South line of the
Village of West Lafayette;
thence, with the Corporation Line of the said Village
of West Lafayette the following four (4) courses;
1. 102 degrees 57' 48", a distance of four hundred three and twenty
hundredths (403.20) feet to a point on the East line of an alley;
2. with the said East line of the alley, 180 degrees 22' 52", a
distance of eight hundred seventy-one and sixty-three hundredths (871.63)
feet to a point on the South line of Fifth Street;
3. with the said South line of Fifth Street, 270 degrees 22' 52",
a distance of ten and no hundredths (10.00) feet to a point at the Northeast
corner of said Lot 891;
4. with the East line of said Lot 891, 180 degrees 22' 52", a distance
of one hundred fifty and no hundredths (150.00) feet to the point of beginning;
The above described tract contains nine and six hundred five thousandths
(9.605) acres, more or less, of which zero and seven hundred twenty-three
thousandths (0.723) acres are within the Right-of-Way of Johnson Road. This
description prepared by R. Scott Johnson, Registered Professional Surveyor
No. 6791, September 26, 2001, and was compiled from various surveys and subdivision
plats and is not based on an "on the ground" survey by the preparer.
3. The Clerk-Treasurer of the Village of West Lafayette shall be and hereby
is instructed to file a certified copy of this Ordinance with the Board of
Commissioners of Coshocton County, Ohio.
4. This Ordinance shall be and herewith is declared to be an emergency ordinance,
the emergency being the need to supply information in a timely manner pursuant
to Ohio Revised Code Section 709.031 to the Commissioners of Coshocton County
as rapidly as possible for the proper consideration at the hearing on annexation
of the within described territory, and this Ordinance shall therefore be effective
immediately upon passage by Council.
