A RESOLUTION AUTHORIZING FIRE PROTECTION AND EMERGENCY
SERVICES TO POLITICAL SUBDIVISIONS PURSUANT TO O.R.C. SEC. 9.60 WITHOUT PRE-EXISTING
CONTRACTS AND DECLARING AN EMERGENCY
Whereas, the State of Ohio has experienced many disasters, and
Whereas, the West Lafayette Fire Department is one of the first agencies
to respond to disaster in our community, and
Whereas, the size and complexity of these incidents often requires a fire
service response that exceeds the resources available through local mutual
aid systems, and
Whereas, section 9.60 of the Revised Code of the State of Ohio states:
Any firefighting agency of the state or any private
fire company may provide fire protection to any state agency or instrumentality,
county, or political subdivision of this state, or to a governmental entity
of an adjoining state, without a contract to provide fire protection, upon
the approval of the governing board of the firefighting agency or private
fire company and upon authorization of an officer or employee of the firefighting
agency providing the fire protection designated by title of their office or
position pursuant to the authorization of the governing board of the firefighting
agency.
Whereas, the West Lafayette Fire Department has studied the need for cooperation
among fire departments during such disasters.
Therefore, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF WEST LAFAYETTE,
STATE OF OHIO that the following resolution be hereby adopted:
1. Effective this date, the Village of West Lafayette
hereby grants approval for the West Lafayette Fire Department to provide fire
protection and emergency services, as determined by the Fire Chief, or officer
on duty, upon the request of any political subdivision located within the
State of Ohio. This authority is hereby granted without the need for pre-existing
contracts of agreements with the jurisdiction requesting these services.
2. This resolution is an emergency measure, the emergency
being the necessity of providing fire protection and emergency services to
political subdivisions within the State of Ohio so as to protect the lives
and property of the citizens of the State of Ohio, and this Resolution shall
be effective and be in force from and after the date of adoption.
