Minutes of West Lafayette Village Council Regular Meeting on June 10, 2002

West Lafayette Village Council met in regular session at 7:00 P.M., in the municipal building with Mayor Jack Patterson presiding.

Pledge of Allegiance

A motion was made and seconded to excuse council member Bordenkircher from the meeting. (RC 4 yes)

Mayor Patterson read a letter of resignation from council member Janice Shannon effective June 10, 2002. No reason was given for the resignation. A motion was made and seconded to accept Ms. Shannon’s resignation. (RC 4 yes)

A motion was made and seconded to approve the minutes from the May 20, 2002, council meeting. (RC 4 yes)

Mayor Patterson reported on the variety of classes and seminars he attended at the recent Mayor’s conference.

Dan Eggan, Don Brown and Dave Gallagher were present to answer any questions that might arise prior to voting on Resolution 2002-15 regarding the wetlands project. The first question presented was the potential insect problem with stagnant water in the area. It was explained that there is considerable water flow in the area most of the year, but even in a dry period any insect problem would be self-controlling since it would be an ecosystem. The other indigenous animal and insect life would assist in the control of any particular species becoming out of control. The next question concerned the ability of the current 18” drainpipe to accommodate the water flow during an excessively wet period. Currently the school will monitor their retention pond pumps and only operated them after the natural flow has cleared. It is anticipated that as the wetland is developed the planned new 24” drain would be financed and installed and the wetlands itself would assist in the control of the drainage. Village Administrator, Bradshaw, ask if during the planning stage of this project the possibility of incorporating drainage of the area East of the West Lafayette Commons could be included. It was asked what the time frame is for the start of this project. Dave Gallagher of Waste Management explained that they hoped to negotiate the purchase of the land and complete the project this year. Any construction would have to be done during a dry period later in the summer. It was the understanding that the 5-year monitoring period would start after the projected was completed and accepted by the EPA. Mr. Gallagher requested that the village have a representative on the planning committee with Waste Management and their engineering firm. It is the desire that at the time this property is turned over to the village, that it be fashioned in such a way that the village will have what they want for the community.  The Mayor read a letter from County Commissioner Grant Daugherty expressing his appreciation of the village council’s cooperation and support of this endeavor.

Ellen Blair was present to again express her concern about the Lafayette Mills retention pond. She alleged that no one was doing anything to address the problem. It was explained to her that with the amount of rain recently, flooding was a problem all over the state, not just the retention pond. For any maintenance to be scheduled and completed there would have to be a dry period of more then a day or two. The owner has contracted to have larvicide applied to the area and mosquito traps have been placed and are being monitored. It was the feeling of the health department that an area this size would not contributed to the mosquito infestation as much as small collection of water such as old tires, bird baths, discarded pop cans and the like. In addition to those contributing factors, the fact that we have received two months of rain has caused an increase in the mosquito population statewide. The mayor recommended that Ms. Blair contact her township trustees since she did not live in the village and she felt the village was not doing all it could do. It was impossible for the village to perform miracles to satisfy her concerns, since the weather was out of the village administration’s control and it was their feeling the owner was responding to the concerns in a reasonable fashion.

Resolutions & Ordinances

            Mayor Patterson explained that with the unexpected resignation of council member Shannon it would not be possible to vote to suspend the 3 reading rule and adopt several ordinances and resolution being presented. Therefore, only the first reading would be given to those resolution and ordinances.

            2002-09 An ordinance to approve the annexation of the Johnson Road area was given a third reading. A motion was made and seconded to adopt Ord. 2002-09. (RC 4 yes) Ordinance 2002-09 was adopted.

            The village Clerk / Treasurer laid the transcript and the accompanying map or plat in the petition required pursuant to ORC 709.04 before the Council of the Village of West Lafayette, Ohio. Ordinance 2002-11 An ordinance to approve the annexation of the North End Area was given a first reading.

            2002-12 An ordinance to adopt a 2002 pay scale for the swimming pool employees and declaring an emergency was given a first reading.

            2002-13 A resolution to authorize application to ODNR Land & water Conservation Fund for financial assistance and declaring an emergency was given a first reading.

            2002-14 A resolution to authorize application to ODNR NatureWorks Fund for financial assistance and declaring an emergency was given a first reading.

            2002-15 A resolution expressing support and acceptance of the wetland and declaring an emergency was given a first reading.

            Mr. Mike Carder, GGC Engineers, was present to address several ongoing projects. In a meeting last week with the pool committee it was decided that the design and construction of a new swimming pool might be more feasible then the extensive repairs required at the existing pool. Resolution 2002-13 and 2002-14 would be required to apply for some of the financial assistance required to complete the estimated $393,000.00 project. The application deadline is July 1, 2002, and if awarded to the village the money would be available in the spring of 2003. The next item was the reimbursement grant from the Army Corp of Engineers for the River Front Estates water & sewer line project. The village was awarded one of the four grants from the federal project for the state of Ohio out of 200 applications. The reimbursement grant could amount to almost $293,000 depending on the Army Corp of Engineers’ administrative costs. The village did not receive a grant from the US EPA for the phase 1 assessment of the brown field cleanup of the Penn-Michigan site. The reason given for the denial was not consistent with the facts of the project. Due to a lack of communication the evaluation committee was under the impression that the project was sustainable. The fact that the several official of the state of Ohio were backing the project and potential funding on the state level was almost guaranteed did not reach the committee. GGC Engineers and the Mayor were embarking on a letter writing campaign to the US EPA and State officials to express their concern and displeasure with the decisions. Mr. Carder did report that during a telephone conversation with the US EPA representative it was implied that they were attempting to find some other way to fund the assessment project.

Reports

            Village Administrator – The pool open on Tuesday June 4th. The bid opening for the River Front Estates project will be June 11, 2002, at 11 AM in council chambers. It is expected that there will be several bids considering the number of plans and specification packages purchased from the engineers. The VA is currently working with Mr. Carder on a Backflow Prevention Policy required by the EPA. This would concern facilities that have alternate sources of water that could potentially come in contact the village-supplied water. The policy would include but not be limited to a manual, restrictions, equipment to be utilized, etc. The policy is to be completed and presented to the EPA this year. The inspection of well #3 has been completed and the videotape is available for viewing. The cleaning process will begin this week with the over all cost approaching $15,000.

            Finance (Warne) – The 2003 budget hearing is scheduled for 6:45 PM on July 8, 2002, at the council chambers.

            Chamber of Commerce Rep (Rogers) – Strawberry festival was a success last weekend. The plans for the village homecoming on July 17th, 18th, 19th and 20th are progressing. The eat stand painting party is scheduled for Saturday June 15th. In case of rain that day the painting party will be June 29th.

A motion was made and seconded to reschedule the June 24, 2002, council meeting to June 17,2002, due to scheduling conflicts of council members and the need to pass several resolutions and ordinances prior to July1, 2002. (RC 4 yes)

A motion was made and seconded to adjourn until the next regularly scheduled meeting on June 17, 2002, at 7 PM in Council Chambers. (RC 4 yes)
