Minutes of West Lafayette Village Council
Regular Meeting on November 11, 2002
West Lafayette Village Council met in regular session at 7:00 P.M., in the
municipal building with Mayor Jack Patterson presiding.
Pledge of Allegiance
Roll Call: Dave Rogers, Roger Warne, Kelly Gossett, Ron Lusk, Christie
Maurer and
Steve Bordenkircher (6 members present)
A motion was made and seconded to approve the minutes from the October 28th,
2002, council meeting. (RC 6 yes)
2002-27 An ordinance to amend municipal income tax ordinance
2000-17 to conform to certain state laws effective 2003, was given a third
reading. A motion was made and seconded to adopt ordinance 2002-27. (RC 6
yes)
2002-31 A resolution to amend appropriation ordinance
2001-46 adding $11,400 to the Water Fund, was given a first reading. A motion
was made and seconded to suspend the 3 reading rule. (RC 6 yes) A motion was
made and seconded to adopt resolution 2002-31.

The mayor reported he had received a letter from Columbia Gas Company regarding
new regulations for service and/or repair work on gas pipelines. Anyone wanting
to review these regulations should contact the village administrator. The
mayor also wanted to relay to council the Ohio Municipal League task force
is currently concerned about pending state legislation that would overhaul
the municipal income tax system in Ohio. The mayor received a copy of a letter
from State Representative Aslanides’ office to Dale Hartle regarding the breakdown
in communications concerning the Penn-Michigan application.
John Hothem was present to express three concerns. 1) The inability of residents
on the south side of the village to hear the tornado warning system. The mayor
and council member Lusk agreed to look into options to improve the warning
system. 2) The lack of stop and speed limit signs in his neighborhood. There
seems to be a lot of speeding in this residential area. The VA is to investigate
adding speed limit signs and initiate a study to determine if stop signs might
slow down the traffic flow. 3) The standing water problem after a storm near
Gay and Seventh Street. Due to the existing utility lines an underground storm
sewer might not be possible. A French drain may be a possible solution.
Reports:
Village Administrator – The utility line extension under US 36
has not been bid yet due to the lack of a permit from ODOT. GGC Engineers
is currently working on obtaining the required permit. The Phase I assessment
for the Penn-Michigan project is approximately 90% completed and should be
finished by the end of November 2002. The VA has obtained pricing for a portable
generator and will be forwarding it to the finance committee chairman for
possible funding.
Police (Chief) – The monthly report for October 2002 was given.
Community Service (Maurer) – The chamber, with the help of the
volunteer firefighters, will be putting up Christmas lights on Main Street
near the end of this month.
Finance (Warne) – The committee has reviewed and approves the
September 2002 financial reports. They are currently working on the 2003 appropriations.
A line item appropriation transfer was recommended to pay GGC Engineers for
the Backflow Prevention plan and Water Distribution Study. A motion was made
and seconded to approve the line item appropriations transfers as recommended.

Fire (Bordenkircher) – The fire departments completed SOPs were
presented to council with a recommendation from the committee to approve them
with a few minor corrections. Bordenkircher felt they did an excellent job.
A motion was made and seconded to approve the Fire Departments Standard Operating
Procedures with corrections. (RC 6 yes) Complete copies will be distributed
to council members, the mayor and clerk at the next meeting.
Pool (Rogers) – The committee met with Carol Wears to discuss
possible rates changes for next season and to review the revenues versus expenditures
of this season.
Chamber Rep (Rogers) – The Lyons Club breakfast, a craft show
and the Christmas parade are all scheduled for December 7, 2002.
Utility (Bordenkircher) – During the past 2 weeks he has attended
several meetings to investigate the concerns raised regarding GGC Engineers
ability to handle the Penn-Michigan project. Chairman Bordenkircher addressed
the following items:
1) Why
the village did not apply for a phase I assessment grant from the state? Dale
Hartle stated he had completed a phase I application but was told by Mr. Magill,
Ohio Dept of Development, not to submit it.
2) How
many projects and / or applications are needed? While it was the opinion of
several people that this could be considered a single project, requiring a
single application, a legal opinion from ODOD was not received until today
(11-11-02). GGC has indicated that this would reduce the fees they will be
charging for Phase I assessment, but no figures were available yet.
3) GGC’s
qualifications to undertake and complete this project? To date, GGC has not
completed a project for ODOD, however Dr. Berdanier is a certified professional
and has completed several projects on the federal level. The chairman and
committee are satisfied with GGC’s progress and have confidence that they
are qualified to continue the project. The committee recommends staying with
GGC as the project engineer.
The Phase I assessment is scheduled to be completed by the end of the month
to accompany the Phase II assessment funding application. It is felt that
funding will be approved approximately 45 days after that. The Phase II assessment
could be completed in late spring or early summer 2003. The one thing yet
to be decided is whether the grant application and administration process
will be an in house activity or contracted outside. The committee will be
meeting with Mr. Hartle to discuss the timeline and fees for his organization
to be responsible for that process. A communication network has been established
with GGC being the hub so that information can be disseminated on a weekly
basis. Council member Bordenkircher had a sample contract from GGC but did
not make a recommendation as to whether the village should require formal
contracts in the future. The Water Distribution Study is almost completed.
There will be some fieldwork in the next couple of weeks. Once that information
is input into the computer model, the village’s water system can be analyzed
under almost any scenario. Bordenkircher asked if anyone knew the reason why
Orchard Street was one-way north from Main Street? The mayor and VA think
it was due to the truck traffic turning from Main Street onto SR 93 north.
Two-way traffic would narrow what is already a sharp turn. Bordenkircher
wanted to remind the mayor, the village, via their legal representative, needed
to respond to the county prosecutor, regarding the overhead bridge.

A motion was made and seconded to approve the payment of bills as presented.
(RC 6 yes)
At 7:55 PM motion was made and seconded to move into executive session to
discuss a property purchase. (RC 6 yes) At 8:15 PM a motion was made and seconded
to return to regular session without any action. (RC 6 yes)
A motion was made and seconded to adjourn until the next regularly scheduled
meeting on November 25th, 2002, at 7 PM in Council Chambers. (RC 6 yes)
