ORDINANCE TO HIRE A SOLICITOR FOR THE REMAINDER OF 2002 AND 2003 AND DECLARING AN EMERGENCY

BE IT ORDAINED by the Council of the Village of West Lafayette, State of Ohio:

     SECTION I:    That William M. Owens be and hereby is named solicitor for the Village of West Lafayette, Ohio, for the period commencing November 1, 2002 and ending December 31, 2003, at a salary of $100.00 per hour effective January 1, 2003 plus reimbursement for all out of pocket expenses, including but not limited to mileage at $.36 per mile.  William M. Owens will be paid in twelve (12) equal monthly amounts of One Thousand and 00/100 Dollars ($1,000.00) each commencing January 1, 2002, together with any amount over Twelve Thousand and 00/100 Dollars ($12,000.00) generated by the $100.00 per hour salary payable on or after January 1, 2004 and before January 30, 2004.  Billing for the balance of 2002 will be at the present rate of $70.00 per hour by William M. Owens as it is budgeted, plus expenses.  William M. Owens is an employee of the Village of West Lafayette.  He shall be designated a location at the Municipal Building to receive mail.  He shall receive all benefits an employee is entitled to who works less than twenty (20) hours per month.

     SECTION II:   That with consent of counsel said solicitor shall be and hereby is authorized to retain such other attorneys, including attorneys not members of his office, in situations and cases involving scheduling conflicts, vacations, and conflicts of interest; said attorneys shall be retained on the same terms as stated in SECTION I supra unless Village Council authorizes other measures, and in addition said solicitor shall be and hereby is authorized to hire investigators, title searchers, surveyors, and such other professionals and assistants as may be necessary, attend continuing legal education conferences, join municipal law organizations on behalf of the Village of West Lafayette, Ohio, and to bill the cost thereof to the Village of West Lafayette, Ohio.  That said solicitor as an employee shall be enrolled in The Public Employees Retirement System.  The employer shall pay its contribution and the employee’s contribution shall be deducted from his salary by payroll withholding.  Either party may terminate this agreement without cause upon thirty (30) days notice to the other party.

     SECTION III: That this ordinance shall be and hereby is declared to be an emergency measure necessary for the health, safety and welfare of the citizens of the Village of West Lafayette, Ohio, for the reason that said position is required to be occupied by law, and the current solicitor has died.  William M. Owens will not be required to make appearances in Coshocton Municipal Court for the Prosecution of Village Ordinances as all said complaints will be filed under the State of Ohio Revised Code.
