RESOLUTION DECLARING IT NECESSARY TO LEVY A TAX IN EXCESS OF THE TEN MILL LIMITATION

The Council of the village of West Lafayette, Coshocton County, State of Ohio, met in Regular session on the tenth day of January, 2005, at the office of Council of the Village of West Lafayette with the following members present:

 

                        Stephen Bordenkircher

                        Kelly Gossett

                        Ronald Lusk

                        Christie Maurer

                        David Rogers

                        Roger Warne

 

M ______________________________ moved the adoption of the following Resolution:

 

WHEREAS,  The amount of taxes which may be raised within the ten mill limitation will be insufficient to provide an adequate amount for the necessary requirements of said Village of West Lafayette, Coshocton County, Ohio;

 

WHEREAS,  Ohio Revised Code Sec. 5705.19 authorizes a levy outside the ten-mill limitation for general operating purposes;

 

WHEREAS, the Auditor of Coshocton County, Ohio has given certification of the total current valuation the taxing district of the Village of West Lafayette, Ohio  and the dollar amount of revenue generated by the specific millage of three (3.00) mills;

 

THEREFORE BE IT RESOLVED,  by the Council of The Village of West Lafayette, Coshocton County, Ohio, two-thirds of all members elected thereto concurring, that it is necessary to levy a tax in excess of the ten mill limitation for the benefit of Village of West Lafayette for the purpose of General Operating Expenses, which levy is a Replacement of an existing levy of three (3.0) mills, to constitute a tax of three (3) mills at a rate not exceeding three (3.00) mills for each one dollar of valuation, which amounts to No Dollars and Thirty Cents ($.30) for each one hundred dollars of valuation, for a period of five (5) years.

 

RESOLVED, That the question of levying additional taxes be submitted to the electors of said Village of West Lafayette at the Primary election to be held at the usual voting places within said Village of West Lafayette on the 3rd day of May, 2005; and be it further

 

RESOLVED,  That said levy be placed upon the tax list of the current year after the February settlement next succeeding the election, if Majority of the electors voting thereon vote in favor thereof; and be it further

 

RESOLVED,  That the Clerk of this Council of the Village of West Lafayette be and she is hereby directed to certify a copy of the Resolution to the Board of Election, Coshocton County, Ohio and notify said Board of Elections to cause notice of election on the question of levying said tax to be given as required by law.

RESOLVED,  This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the citizens of West Lafayette, Ohio.  Whereas it appears for the best interest and for the peace, health and comfort of the inhabitants of the Village of West Lafayette, Ohio, this resolution shall therefore take effect and be in force immediately upon passage by the Village Council.
