NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF WEST LAFAYETTE, OHIO:
SECTION 1. No minor under the age of eighteen years shall be or remain in or upon any street, alley, or other public place of the Village of West Lafayette, Ohio, between the hours o f 11:00 p.m. and 6:00 a.m. unless accompanied by his parent, guardian or other adult person having the care of and custody of the minor, unless the minor is upon emergency errands, unless on legitimate, lawful business, unless the minor is attending or returning directly from a properly supervised school or church function, or unless the minor is going or returning directly to or from his place of employment.
SECTION2. No parent, guardian or person having the legal custody and control of any minor under the age of eighteen (18) years shall knowingly permit such minor to violate any of the provisions of this section.
SECTION 3. Minors violating any of the provisions of this section shall be dealt with in accordance with Juvenile Court Law and procedure.
SECTION 4. Whoever violates any of the provisions of this section is guilty of a minor misdemeanor for a first offense and for a second or subsequent offense is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 137.01.
SECTION 5. This ordinance is hereby declared to be an emergency measure, immediately necessary for the preservation of the public peace, health and safety, such emergency existing by reason of the reason that steps need to be taken to curb the disorderly conduct and vandalism now existing in the village and this shall take effect and be in force immediately upon its passage by at least two-thirds of all members elected to Council, otherwise from and after the earliest period allowed by law.
